02 // WHAT A NOTICE MUST INCLUDE

To be effective under 17 U.S.C. § 512(c)(3), your notice must contain substantially the following:

  1. 01A physical or electronic signature of a person authorized to act on behalf of the owner of the right allegedly infringed.
  2. 02Identification of the copyrighted work claimed to be infringed, or a representative list if multiple works are covered by one notice.
  3. 03Identification of the material claimed to be infringing, with information reasonably sufficient for us to locate it — a URL, design ID, or order number.
  4. 04Information reasonably sufficient for us to contact you: address, telephone number, and email address.
  5. 05A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  6. 06A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the right allegedly infringed.

Incomplete notices may not be actionable. Under 17 U.S.C. § 512(f), a person who knowingly and materially misrepresents that material is infringing may be liable for damages.

03 // WHAT WE DO

We remove or disable access to reported material pending review, and we notify the person who submitted it.

04 // COUNTER-NOTIFICATION

If your material was removed and you believe that was a mistake or misidentification, you may send a counter-notification under 17 U.S.C. § 512(g) to the agent above, containing:

  1. 01Your physical or electronic signature.
  2. 02Identification of the material removed and where it appeared before removal.
  3. 03A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
  4. 04Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for your judicial district — or, if outside the United States, for any district in which we may be found — and that you will accept service of process from the complaining party or its agent.
05 // REPEAT INFRINGERS

We terminate the accounts of repeat infringers. Two substantiated notices disable Design Studio uploads; three close the account.
